Glyphosate Now Has Extra Legal Protection: A Farmer's Take on the Supreme Court's Bayer-Monsanto Ruling

Well, well, well, well, well......

What was absolutely always going to happen has happened.

The Supreme Court ruled in favor of Bayer-Monsanto.

Here's what the Supreme Court glyphosate ruling actually means for anyone who eats food in America.

What the Supreme Court actually ruled

The basic gist is that because the EPA never made Bayer put a cancer warning on the Glyphosate label, you now can't sue them under your own state's laws for not warning you. Federal 'we say it's fine' beats your state's 'actually, it gives people cancer.'

This is insane.

It strips power from the states to defend their own citizens, and opens the door to all kinds of fun rulings down the line, where any company can dodge state level lawsuits as long as some captured federal agency rubber-stamped their product first.

Bayer is calling it a win for "science, farmers, and innovation." It's not.

Bayer naturally pitched this as a win for "science, farmers, and industries that depend on regulatory clarity for innovation." Which is a sentence that would be really funny if this wasn't really happening....

Because it's not that. It's a win for mega-corporations that can legally bribe (but definitely NOT blackmail!) our truly loathsome political class into giving them exactly what they want.

Scientists who aren't on Bayer's payroll, in most states and many countries, have looked at the same glyphosate and decided it DOES cause cancer, that warning the public about it is a reasonable thing to do, and even that it should be banned or restricted. Farmers are a meaningful chunk of the people who just got stripped of their legal protection and their standing to fight back. And if your industry needs federal protection from liability for poisoning people and hiding it, that's probably not the kind of innovation we're looking for.

But screw all that, because Bayer is a big donor, so whatever "science" they can cobble together reigns supreme.

Instead, this government seems absolutely obsessed with Glyphosate Maxxing, since just this year we've seen:

• A Trump executive order invoking the Defense Production Act for glyphosate, which would hand them one form of liability protection.
• A provision (thankfully defeated) snuck into a Farm Bill draft to hand them even more.
• And finally the Justice Department formally siding with Bayer, a German poison manufacturer, over American citizens, in a case ultimately decided 7-2 by a bipartisan majority.

That's all three branches of our government, in one year, spitting in the face of the American people, who have been pretty clear that they'd prefer not to get poisoned quite so much.

Sadly, that's unimportant to the powers that be. More than ever, it's clear our government exists to defend the interests of its corporate sponsors.

Bayer has settled $11 BILLION in glyphosate-cancer lawsuits, and clearly they've had enough. A few million bucks per electoral cycle is cheap insurance, and boy did it pay off.

As George Carlin said, "it's a big club, and you ain't in it." You, in this case, being every human, animal, and soil microbe alive who can't escape to Mars or whatever utopia they're building down at the South Pole.

What's coming down the industrial food pike

With this one in the rearview, and precedent now set to disarm state-level protections, it's pretty clear what's coming down the industrial food pike....

More poisons. Less transparency.

More sickness. Less accountability.

The people who run these businesses, and their sniveling political lapdogs, do not care about you, or me, or our kids, or your livelihood, or the f***ing planet we all depend on.

The only thing they care about is quarterly earnings (and presumably making sure that whatever blackmail file exists about whatever they were doing on that island doesn't get dumped online....).

What you can actually do about it

Hit them where it hurts. Don't buy their industrial slop.

Opt out. Shop local. Find a farm you trust. Buy from people you actually believe wouldn't poison your family and then bribe the government to make it illegal to sue them.

P.S. The media coverage of this issue is extremely telling. It's not exactly buried, but it's certainly not getting anywhere near the run as yesterday's Supreme Court immigration rulings, or the earthquake in Venezuela, or season 8 of the "will they or won't they?" War with Iran saga. Which is weird since we're all being poisoned and our state governments lost the right to protect us, and I am sure this has nothing to do with Bayer's Billion Dollar advertising budget for the pharmaceuticals they manufacture to treat the diseases that their poisons give us.
